HOLLYWOOD—On December 20, after a public show cause hearing at the Nantucket District Court, Clerk Magistrate Brian Kearney issued a criminal complaint of indecent assault and battery against Kevin S. Fowler, better known as actor Kevin Spacey.

The incident is alleged to have occurred on or about July 7, 2016 at a local restaurant. An arraignment is scheduled for January 7, 2019 at Nantucket District Court.  The victim’s mother, former Boston TV anchor Heather Unruh spoke about the incident during a press conference on November 8, 2017, involving her son and Spacey. Unruh wiped away tears from her face as she spoke about the incident.

“It happened late at night inside the Club Car Restaurant and Bar on Nantucket Island. The victim my son, was a star struck, straight 18 year-old young man, who had no idea that the famous actor was an alleged sexual predator or that he was about to become his next victim,” said Unruh.

“My son was not of legal age to drink alcohol. He told Kevin Spacey he was of legal age. Rather he was over 21 or not, Kevin Spacey had no right to sexually assault him. There was no consent. And when my son was drunk, Spacey made his move and sexually assaulted him,” she added.

“Spacey stuck his hand inside my son’s pants and grabbed his genitals and my son’s efforts to shift his body to remove Spacey’s hands were only momentarily successful; the violation continued. My son panicked; he froze. He was intoxicated and Kevin Spacey was insisting he come with him to a private after hours party to drink even more,” said Unruh.

“Fortunately, Kevin Spacey left briefly to use the bathroom and when he was out of sight a concerned woman quickly came to my very shaken son’s side and asked if he was ok. Obviously she had seen something and she knew he was not. She told him to run and he did,” Unruh added.

Spacey has not public released a statement in response to the charges, but did post a video on Twitter where he spoke in a cadence similar to his character Frank Underwood on the now defunct Netflix series “House of Cards.”

“I know what you want…Oh sure, they may have tried to separate us, but what we have is too strong, too powerful. After all, we shared everything, you and I. I told you my deepest, darkest secrets. I showed you exactly what people are capable of. I shocked you with my honestly, but mostly I challenged you and made you think. And you trusted me, even though you knew you shouldn’t. So we’re not done, no matter what anyone says. And besides, I know what you want. You want me back,” said Spacey in the video.

“Of course, some believed everything and have been just waiting with bated breath to hear me confess it all. They’re just dying to have me declare that everything said is true and that I got what I deserved. Only you and I both know it’s never that simple, not in politics and not in life,” he says. “All this presumption made for such an unsatisfying ending, and to think it could have been such a memorable sendoff…I can promise you this. If I didn’t pay the price for the things we both know I did do, I’m certainly not going to pay the price for the things I didn’t do.”

“Now that I think of it, you never actually saw me die, did you? Conclusions can be so deceiving. Miss me,” says Spacey as he concludes the video.

The Los Angeles County District Attorney’s Office declined to file charges against Spacey for an alleged 1992 incident in West Hollywood because it passed the statute of limitations. The allegation was made by a man who claimed that Spacey sexually assaulted him.

Spacey won two Academy Awards: one for Best Supporting Actor for his performance in “The Usual Suspects” and Best Actor for “American Beauty.” He recently starred in the Netflix series “House of Cards,” but was fired from the series after the sexual assault allegations arose. Spacey has been accused of sexual assault by at least 15 men, with allegations that span over decades.

Actor Anthony Rapp made the first public allegation against Spacey, where he that in 1986, when he was only 14, Spacey sexually intimidated him in a hotel room. After Rapp came forward, Spacey issued a public statement in which he said he didn’t remember the incident, but that he was sorry for “deeply inappropriate drunken behavior.”
