SAN FRANCISCO—The SFDA’s Office disclosed on October 16 that Luis Rebolledo, 37, of San Francisco, was charged in connection with a fatal Mission District shooting. He is charged with one count of murder (PC 187(a)) and a special circumstance under Penal Code section 190.2(a)(22) alleging that he did so as an active participant in a criminal street gang and to further the activities of the gang.
He has been charged with attempted robbery, attempted extortion, and various violations for unlawfully possessing a firearm. The criminal complaint also alleges that Rebolledo intentionally discharged a firearm (PC 12022.53(d)), causing the death of the victim.
Prosecutors moved to have him detained pending trial because of the public safety risk he poses. He remains in custody at this time.
According to court records, on July 24, at approximately 5:41 p.m. officers with the San Francisco Police Department were dispatched to 16th Street and Mission Street for the report of a shooting. Officers arrived on scene where they found the victim with a single gunshot wound to the chest. The victim was taken to hospital where he was pronounced dead. Witnesses on scene stated that the suspect, later identified as Luis Rebolledo, and his associate were walking around the 16th Street and Mission Street Bart Station Plaza allegedly charging the street vendors “tax.”
One witness stated that the defendant allegedly told him he needed to pay to sell in the area, and when the witness balked, Rebolledo allegedly raised his shirt to show that he had a concealed firearm. The witness agreed to pay Rebolledo starting the next day. The defendant’s associate allegedly went to a group of women to collect the tax but the women resisted, and Rebolledo’s associate started fighting them. The victim went over to the fight in an apparent attempt to stop it. Rebolledo allegedly pulled out a firearm and discharged approximately four shots toward the area, striking the victim in the chest. The defendant allegedly fled the area and was caught on surveillance discarding the murder weapon.
He was arrested by the SFPD in Antioch, by members of the Police Department’s Homicide Unit and the Community Violence Reduction Team on October 13. Rebolledo is scheduled to be arraigned on November 12, at 9 a.m. in Department 10 at the Hall of Justice.
The SFPD is still investigating the case. Anyone with details is asked to contact the SFPD Tip Line at 1-415-575-4444 or Text a Tip to TIP411 and begin the text message with SFPD.
