South Bay, CA – On Tuesday, December 10, 2024, a collision between a pickup truck and SUV resulted in the death of a 66-year-old San Jose man and the hospitalization of his passenger, according to KBAK.

The City of Santa Clara reports that the fatal accident occurred around 12:19 PM on Stevens Creek Boulevard near Tyler Street.

Investigations suggest that the San Jose man, driving the SUV, had been attempting to make a left turn into a driveway from Stevens Creek Boulevard when his vehicle was struck by a pickup traveling at a high rate of speed.

Emergency responders arriving at the scene found the San Jose man had been ejected from his vehicle by the force of the crash. His passenger, a 65-year-old woman, was also seriously injured in the accident and received transportation to a nearby hospital for treatment.

The driver of the pickup truck involved in the crash, a 20-year-old man, remained at the site of the accident and cooperated with police in their investigation. A passenger of his was also injured in the crash.

Authorities have stated that drugs and alcohol are not believed to have been contributing factors in the fatal accident. The investigation into the causes of the crash is ongoing.

Wrongful Death Claims

Determining fault in a collision can involve multiple factors, and under California’s Comparative Liability rule, several parties can share partial responsibility. A personal injury attorney can play a crucial role in helping victims establish legal responsibility after a traffic accident.

Should someone else be found even partly responsible for the death, the family may be able to file a Wrongful Death claim against the at-fault driver’s insurance. This can provide compensation to help cover medical bills, funeral expenses, and the loss of income to support the family of the deceased.
