SAN FRANCISCO—On Monday, September 15, the San Francisco District Attorney’s Office announced charges were filed against Daniel Patrick Rodriguez Jr., 42, with murder in connection to a fatal stabbing on September 10. He was arraigned on September 16, at the Hall of Justice. The District Attorney’s Office will move to have him detained pending trial due to the public safety risk he poses.
He is charged with one count of murder (PC 187 (a)) and one count of child endangerment (PC 273(a)(a)). The criminal complaint also includes an allegation that Mr. Rodriguez personally and intentionally used a deadly weapon in the commission of the murder (PC 12022.1(b)).
According to court documents, on September 10, at approximately 4:43 p.m. the San Francisco Police Department responded to the intersection of Junipero Serra and Ocean Avenue on a report of a stabbing. Multiple witnesses saw Rodriguez and the victim, allegedly pushing and punching each other. Multiple bystanders stopped to break up the altercation.
While bystanders were attempting to break up the fight, the defendant allegedly walked around the witness and stabbed the victim once in the neck. After allegedly stabbing the victim, Rodriguez walked away calmly. The victim’s eight-year-old son was present during the incident. The suspect was taken into custody on September 12, by the SFPD in Tuolumne County, California.
