San Jose, CA – A pedestrian who was seriously injured in a vehicular collision on the evening of Tuesday, November 26, 2019, has passed away from those injuries more than five years later, according to Bay City News.
The San Jose Police Department reports that the crash occurred around 5:30 PM in the 2000 block of Monterey Road.
A 2009 black Toyota sedan traveling northbound struck a man who was crossing the roadway outside of a marked crosswalk. The man was transported to a hospital with critical injuries and later transferred to a long-term care facility after being stabilized.
The Santa Clara County Coroner’s Office informed police last Wednesday that the man, whose identity has not yet been released, had died from injuries sustained in the 2019 collision. Authorities have not confirmed whether the driver remained at the scene at the time of the incident. The death marks San Jose’s 59th traffic-related fatality for the year 2019.
Duty of Care Toward Pedestrians
Drivers have a Duty of Care towards pedestrians, who are particularly vulnerable in traffic accidents. This responsibility includes being vigilant for pedestrians near the roadway and, if a collision occurs, staying with the victim to ensure they get proper medical treatment and cooperating with authorities investigating the crash.
Statute of Limitations & Wrongful Death Claims
Victims of motor vehicle accidents typically have up to two years after the accident in order to file a claim. However, in a Wrongful Death Claim, that timer only starts after the victim has lost their life, which can happen well after the accident that caused their injuries.
